Recognition of certificates – Hungarian Equivalence and Information Centre (MEIK)
The Provision Registry (in Hungarian: Rendelkezési Nyilvántartás; hereinafter referred to as: RNY) is a central electronic administration service that registers the provisions of natural persons and business organizations regarding E-administration and provides access to these for those entitled. By using the service - after the necessary identification - clients can record their administrative provisions and legal declarations electronically as a private document of full evidence, which can be accessed in a register by the clients and the bodies entitled to recognize them, who are connected to RNY.
The service makes it possible to record data in connection with the contact, and statements, as well as to make additional provisions regarding identification and notification services. The register also stores the authorizations recorded in the case catalogue of the affiliated bodies available in the RNY, and provides verified information about them without the need of a paper-based document. Under the current legislation, bodies providing electronic administration are obliged to take into account the client's administrative provisions in the case of both electronic and non-electronic communication.
Only natural persons over 18 years old who are subjects to one of the personal base registries (Personal Data and Address Registry, central register of aliens or the register of natural persons living abroad) can make administrative provisions. Documents and their attachments submitted by electronic means shall be verified electronically. Based on the implementing decree of the E-Administration Act, (Government decree 451/2016. (XII.19.) on the detailed rules of electronic administration) an electronic document is authentic if:
Documents and attachments submitted on the ekozig.mo.hu website or through the SZÜF e-paper service are automatically signed and authenticated before submission, no additional steps are needed by the clients. In other cases verification by Identification Based Document Authentication services is recommended, which can be done by the client on the following website after Client Gate registration, and entry: https://niszavdh.gov.hu/index
Based on the implementing decree of the E-Administration Act, Educational Authority selects the file formats accepted during electronic communication. The descriptions of the separate systems specify the types of eligible file formats. Educational Authority accepts the following file formats during email communication: .pdf, .docx, (.doc, .dot cannot be accepted for reasons of security), xlsx, .pptx, .jpg, .png, .odt, .csv, and their compressed file formats and their electronically signed versions in .zip, or .asic formats.
Article 15 of the E-Administration Act contains the rules of delivery to natural persons. The secure address of natural persons is the Client Gate repository (KÜNY-repository); clients receive emails in case of incoming notifications.
Natural persons are entitled to set an official notification address regarding their administrative declarations. In this case the provisions of Article 14 the E-Administration Act shall apply to the date and presumption of delivery.
If the natural person client does not provide an official contact, the body providing electronic administration may attempt to send the notification to the known electronic contact of the client – if this has not excluded in the client's administrative provision. In this case, after the second unsuccessful delivery attempt, the Educational Authority is obliged to deliver the document or notice by other means. In the case of unofficial contacts, the fact of delivery can be proved in accordance with the relevant legal regulations; no presumption of delivery applies to this delivery.
If the client has declared an e-mail address, a telephone number suitable for receiving text messages or other means suitable for electronic contact in his declaration addressed to the Education Authority, and has not made different administrative provisions, the Educational Authority is entitled to provide information on these contact details. If the client also has an official contact, the Educational Authority will primarily use that, using the other contact details only for notification or information. Consignment sent to a secure address has the same legal effect as postal delivery. A consignment delivered to an official contact shall be considered delivered if the official contact provider confirms that:
7.1 Obligation of electronic identification
The client is entitled to electronic administration without electronic identification if the procedural or administrative act or the making of a statement does not require the provision of personal identification data in the case of non-electronic administration.
In the case of non-electronic administration - if permitted by law - the client may perform a procedural act or statement electronically that otherwise needs the client's personal appearance if he / she identifies himself / herself with an electronic identification that ensures that the client’s name is available to the Educational Authority and the additional data necessary for identification is available to the electronic identification service provider.
7.2 Obligation to verify identifiers and data
With the exception of the data necessary for the identification of the client, the Educational Authority does not request the client to certify data that has been published by the body registering the data concerned in accordance with Act CXII of 2011 on informational self-determination right and freedom of information (hereinafter referred to as: Info Law) or which must be included in the public authentic register systematized by legislation.
If, in a case that can be handled electronically, the law requires the submission of an original copy of a document, the client may do so with a certified electronic copy - unless otherwise provided by law or government decree. If the authenticity of the original copy is in doubt on which the authentic electronic copy is based, the client is obliged to present it at the request of the Educational Authority.
If the legislation requires the submission of several copies of a document, unless otherwise provided by law or a government decree in the original legislative competence, the client is obliged to submit only one copy in the case of electronic administration.
7.3 Right of disposal
The client can make a legal declaration under an administrative provision at the body designated in the Government Decree in the following areas:
We would like to draw the attention of our clients to the fact that in accordance with the law, authorization may also be given in the Provision Registry. If, in the case of a declaration, the law requires that it be recorded in writing or in a private document providing full evidence, the declaration of the administrative order satisfies that requirement. The declaration entered in the Provision Registry is valid for all bodies providing electronic administration, unless the client has disposed otherwise or if he uses electronic administration without electronic identification. In an ongoing case, the Educational Authority will only take into account the new administrative provision entered in the Provision Registry or its amendment if the client notifies the Authority.
7.4 Right to electronic information
The client is entitled to request and receive information necessary for electronic administration from the Educational Authority via customer service or electronically. At the request of the client, the Educational Authority shall forward the document issued by the body providing electronic administration, as a non-certified electronic copy for information, free of charge, electronically to the contact address provided by the client.
A natural person client is entitled to pay the public charges, administrative fees and the consideration for the services electronically for the administration, unless otherwise provided by law or a government decree created in the original legislative competence.
A business organization client is obliged to pay the public charges, administrative fees and the consideration for the services electronically for the administration, unless otherwise provided by law or a government decree created in its original legislative competence.
9.1 Availability
Educational Authority ensures the availability of its systems and electronic administration during working hours (Monday to Friday from 8.00 am to 4.30 pm).
The duration of the planned outage and the special maintenance (version change) is not included in the service outage time and is not taken into account when calculating the annual availability. The time required for system outages during scheduled maintenance work, if done in the maintenance window, does not reduce the time of availability.
9.2 Outage, malfunction
9.2.1 Announcement of regular maintenance
“We inform ............... clients that the maintenance of ............... (system) will happen on ...... .................. (date) during which the period ...................... .. (activity) is not possible. The ..................... operate even during maintenance. In accordance with the Government Decree No. 451/2016. (XII. 19.), the day on which a breakdown lasts at least 4 hours and prevents the electronic administration, is not included in the deadline. The Authority shall take into account in its proceedings if clients are delayed through no fault of their own. "
9.2.2 Announcement of planned outage
“Due to the planned maintenance of ..................... (system) between ............ (date) on the Internet ............... service is temporarily unavailable. In accordance with the Government Decree No. 451/2016. (XII. 19.), the day on which a breakdown lasts at least 4 hours and prevents the electronic administration, is not included in the deadline. The Authority shall take into account in its proceedings if clients are delayed through no fault of their own. "
9.2.3 Unplanned outage (general power outage)
In the event of an unplanned downtime of several hours or an event causing limited functionality of electronic administration (hereinafter: malfunction), the Educational Authority shall immediately publish information on the electronic administration site, on the website www.magyarorszag.hu and on its own website. It contains the exact definition of the administrative services affected by the malfunction, the changes in their operation, the contact details of the customer service, and if the electronic administration can be performed on another electronic site not affected by the malfunction, its contact details.
9.2.4 Procedures to be followed by the client in the event of outage or malfunction
The Educational Authority extends the deadlines by the days affected by the malfunction or in the manner and tract prescribed in the legislation applicable to the given procedure.
